The article discusses about the role of public Moslem finance institution viewed in the context of economic public endeavor. This problem emerges in public because the public Moslem finance institution in Indonesia does not take in part proportionally yet to mate public prosperity in Indonesia whereas the research of the language and literature Center in UIN by Syarif Hidayat¬ullah and Ford Foundation results that the potention of funds (Zakat, Infak, Shodaqoh) and donation of Moslems in Indonesia (amount Rp 19.3 billions) managed by the public Moslem finance institution can be used for people prosperity. Besides, it is supported with the big number of Moslems in Indonesia. Therefore, there are two important things to be focused on this article. First, why can't the fund in public Moslem finance institution, like ZIS and donation, in Indonesia be more efficient in a maximum way to realize the prosperity? Pemahaman Praktisi BMT di Yogyakarta Terhadap PSAK No. 59 (Akuntansi Perbankan Syariah) Pengakuan dan Pengukuran Produk Funding

The objective of this research is to explore BMT practitioners' understanding about the SFAS No. 59 on Shari'ate Banking Accountancy for finding product. For this reason, the research is conducted using descriptive method. Field research using quantitative approach is also used. However, qualitative approach is also used to explore and to clarify as well as to compare between the concept and the real situation. The population used in this study is member of PUSKOP¬SYAH DIY, and the subjects of this research are the managers and accounting staff of these BMTs. The sample consists of 30% of 80 active members. However, since the magnitude of each sub-population is different, proportional sampling method is used to determine the number of sample taken from each sub-population, and purposive sampling method is used as the sampling method. The independent variables used in this research are age, educational background, the length of time working in BMT, and the frequency of training or workshop joined by the subjects. Meanwhile, the dependent variable in this research is the BMT practitioners' understanding about SFAS No. 59 for funding product. Data gathering method used in this research was questionnaire, field observation and interview. In fact, business activity neglecting ethics harms consumers and employees as many cases occurred in this country i.e. formalin case, little wage, oil stealing in Kalimantan, industrial cesspool, transaction of stolen wood, etc. Such facts and cases, to ethical perspective, are due to separation between ethics and business which has a negative impact on human lives. But, ethics and business are two entities being able to be united as one. According to Islam, business is not only an activity to get financial profit, but also the activity to attain essence of humanity as implementation of which becomes human responsibility as creature and caliph in achieving Allah's favor. Therefore, Islam teaches values of business practice such as unity, freedom, responsibility, equality, virtue, and honesty. It is an valuable teaching that all parties like producer, consumer, employer, employee, and society must apply business ethics, because this does not deal with vertically producer's responsibility only, but also with existence of business activity its self. Summarily, mutual and harmonious relationship among involved parties in business activity will be constructed, if values of business ethics are held as fundamental source for their business practice. Mengkaji Kebutuhan Floating Market Muslim terhadap Bank Syariah (Studi Kasus Anggota Pengajian Bisnis Al-Kautsar NU di Wilayah DIY)

Entrepreneurs of NU, engaged in the al-Kautsar religious gathering, can be deemed as having good education and structural position either as a member or an organizer. They declare that NU institutionally gives a big contribution to their business. Their companies are generally home-industries in which they themselves pay the capital. Though the profit is less than IDR 5,000,000, they are aware of developing their industries. Their participation in the Islamic organization, NU, does not mean that they do not choose the conventional banking system, not the shariah one. Their choice is based upon a consideration which banking system is more beneficial for them. To put simply, it can be said that they will be enthusiastic and interested in utilizing the services of shariah-banking system if they could get more benefits. However, they prefer interest system than profit-sharing system. They consider both systems as being at the same position and regard interest as religiously acceptable. Therefore, they believe that conventional banking system is allowed in Islam. Though having preference to conventional banking system, they still possibly utilize shariah-banking system as long as it can give more facilities and benefits and confess that shariah-banking system is in line with their religious doctrines.Keywords: pasar mengambang, pengusaha NU, bank syariah

Perdebatan masalah riba seperti tidak pernah selesai di diskusikan oleh banyak kalangan, baik akademis, organisasi keagamaan, bahkan sampai pada forum-forum intenasiona1. Beberapa terminologi dibahas dengan baik dalam tulisan ini yang dimulai dengan pelarangan riba itu sendiri kemudian pembagian-pembagian riba, diantaranya riba al-Nasi'ah dan riba al-Fadl serta implikasi dari dua bentuk riba tersebut. Pembahasan didukung dengan pendapat¬-pendapat para ulama dan ekonom yang meruijuk langsung dari ayat-ayat aI-Qur'an, sampai pada perdebatan hukum. Demikian juga al-Qur'an sangat jelas membedakan antara riba dan perdagangan, namun pelarangan riba sangat jelas bahkan diperkuat dengan hadits-hadits yang dengan eksplisit melarang riba. Dijelaskan pula tentang perbedaan antara riba dan bunga bank. Islam sangat menentang bunga bank karena Islam berharap terjadinya sistem ekonomi yang mengeliminasi seluruh bentuk ketidakadilan dengan memperkenalkan keadilan antara pengusaha dan pemilik modal yaitu berbagi resiko dan berbagi hasil.

Tafsir Ayat-Ayat Tentang Konsumsi (Aplikasi Tafsir Ekonomi al-Qur'an)

This essay tries to develop economic studies from the point of view of Quranic economic tafsir. As a methodology, tafsir plays significant role in order to develop Islamic economic discipline. This model of economic tafsir derived from the thematic Quranic interpretation is developed through four phases including; classification of Quranic verses pertinent to economic affairs, understanding them based on chronology, micro and macro context, and socio-economic contextualization. To sum up, this paper reveals that the consumption behavior in the Quran is ruled harmoniously, gradually and systematically in order to propose the new model of consumption for the Muslim community through eight axiomatic Islamic consumption behavior. The appearance of the modernity has resulted in many revolution on human lives. Since the intervention of highly modern devices in communication, for instance, we find multitude of ways how humans express their will to get in touch with one anothers in etremely unimaginable manners long time ago. This has much benefited people for they are getting easier to do and get everything in this modern world. Nonetheless, not only does this results in merely positive impacts, but there we also find how modernity has overshadowed many worldly traditional norms and, in some degrees, has made them blurred in daily relation. Basically, those 'traditional' norms function as a code of cunduct for human to mirror their deed so that the broke of this worldly life can be avoided. In this sense, it will be interesting when we relate The West and Islam in announcing the salience of a norm and its values in daily modern lives. This essay wants to look at briefly how Islam and the West appeal humans to internalize ethical norms in daily interaction, especially in the world of business. With emphasizing to truth Islam and refusal to taqlid, bid'ah and churafat, Muhammadiah has appreciation to Islamic mysticism (read: akhlaki Islamic mysticism). Although Islamic mysticism is more individual necessity and the term has never been mentioned, but many of Muhammadiyah figures practice Islamic mysticism individually. It was began from founder of Muhammadiyah, KH. Ahmad Dahlan and other figures, such as: Ki Bagus Hadikusumo, KH. Mas Mansyur, Buya Hamka, AR Fakhruddin, etc. A.R Fakhruddin him self can be addressed as Kadda an yukuuna Suufiyan (near to be a Sufi), in this case Sufi Akhlaqi. It is caursed by all akhlakul karimah characteristics have already mixed up in his soul, such as: patient, thank God, Wara Zuhud, Qana'ah, Tawakkal, Ikhlas, Risha, etc. In the meantime, his spiritual life which fills more of his life and it is reflecting Islamic mysticism attitudes. A Sufi's live can be reflected from his attitude and thought about: taubat, taqarrub, dzikrullah, khusyu', tawaddhu', khauf, raja, muraqobah, and istiqamah, these maqam are common to be done in Islamic mysticism world. Muhammadfyah, mysticism, Sufi Akhlaqi, Spiritual and maqam.

The aim of this writing is to describe the relationship between religious ethics and good governance values to create a good corporate governance and good government governance. Some people argue that the implementation of the good corporate governance is not satisfactory yet, due to the lack of awareness of the government authority, private companies’ stakeholders, scholars, and society on the importance of the system for both government and non-government organizations. Therefore, to provide a comprehensive understanding to the scholars and practitioners, this paper attempts to explain the corporate governance anatomy, Islamic values, and social condition of Indonesian society, which may become an appropriate model of corporate governance for the private companies, government institutions, government, and non-government organizations.

Fighting Against Corruption (A Political Biography of ‘Umar Ibn ‘Abd al-‘Aziz)

Umar ibn Abd Aziz was a great leader throughout Islamic history. He has shown an outstanding role in the Umayyad Dynasty. He differed from some of his corrupt, unkind and injustice predecessors. This Caliph, well-known as Umar II, usually made popular policies to his people. He is the legendary leader who has many interesting historical evidences that encourage researchers to make further studies. His policies were always based upon Al-Qur’an and Hadits. On the one hand, he led and treated his people with justice; and on the other, he was very strict to his officials or people who corrupt or violate Allah’s rules. This study reveals various political decisions that were made during his leadership. Based on the various sources, many political decisions that he made may become references to be followed by Moslem leaders today and in the future time.Keywords: Economic policy, government system, social welfare, and justice

Saddam Hussein’s Trial: The American Hegemony and A Good World Governance Tragedy

After the destruction of the U.S. World Trade Center on September 11, 2001, America was focusing its international political policy on war on terrorism which was further followed by preemptive action and unilateralism toward countries considered as terrorists. One of them is Iraq. Certainly the policy will obstruct the realization of good world governance under the United Nations Program. Attacking Iraq in 2003 was a real proof of the U.S. hegemony over the world as the Super Power country, especially concerning Saddam Hussein’s judicial process which was held by the Iraqi Special Tribunal which was under the U.S. intervention. Theoretically, the judicial process of Saddam Hussein’s case who was accused of genocide toward Kurdish should be held by the International Criminal Court (ICC) under the United Nations. It was not the competence of the Iraqi Special Tribunal. Saddam Hussein’s trial was invalid and violated the principals of international law. This case would obstruct the enforcement of international law supremacy which is one of the requirements of good world governance. Since international politics is under the U.S. hegemony, the realization of good world governance is in jeopardy.Keywords: Governance, politics, hegemony, and law supremacy

From Good Governance perspective, Indonesia has given positive contribution toward gender issues. Legally, Indonesia has fulfilled all conditions as state with good governance, but unfortunately, at the field showed that such ordinances issued were ineffective. PSI-UII’s research report has found the correlation between violence against women and religious understanding. In the field finding will give inputs to all people who concern with the issue. Several Muslim scholars already had given us some solution with interpretation toward al-Quran and Hadits, which support gender justice and equality. Tulusan ini hendak mengkritik kondisi politik umat Islam Indonesia dewasa ini. Hal ini didasarkan pada adanya sekian banyak konsep politik dalam Islam sebagaimana juga ada dalam agama-agama besar lainnya. Dengan merujuk pada adanya keyakinan dalam agama Islam (tauhid), dimungkinkan untuk menjawab berbagai tuduhan yang dialamatkan pada umat Islam dewasa ini. Pembahasan diawali dengan membahas konsep diktator dan kemudian diakhiri dengan konsep demokrasi. Hasilnya menunjukkan bahwa ada banyak konsep dalam Islam tentang politik kenegaraan sehingga sistem politik demokrasi hanyalah merupakan salah satunya saja. Anehnya, pihak-pihak yang melakukan tindakan kekerasan berasal dari lembaga, organisasi, dan aliran keagamaan yang menuduh penganut aliran keagamaan lain sebagai sesat. Lebih aneh lagi, MUI yang selama ini menjadi eksekutor Tuhan, sama sekali tidak menfatwa sesat tindakan kekerasan yang dilakukan mereka yang mengatasnamakan agama. Peristiwa itu nampaknya tidak lepas dari klaim kepemilikan dan kebenaran atas nama agama yang dilakukan oleh sebagian mereka. Akibatnya, agama dijadikan justifikasi atau pembenaran tindakan kekerasan itu sendiri. Agama akhirnya berwajah kekerasan, bukan membawa kedamaian sebagaimana missi awal. New Prophet versus the State (A Study of the Phenomenon of New Religious Streams in Indonesia)

This paper elaborates a phenomenon of the new Prophet in Indonesia. The New prophet of community is left (separated/heretic) by Majlis Ulama Indonesia (MUI) because such community is considered to perform heresy in religious mainstream (Islam). Why does this grow? What is simultaneous aspect within social ills, such as state failure in managing plurality in Indonesia, or is that connected with religious mission (Dakwah) in this contemporary phenomenon? This paper introduces state failure on dakwah/mission in Islam, pluralism management, and destructed national politics and economic growth. In this paper I describe mass destructive on sect (heresy) community by MUI. This paper presents religious sociological perspective as religion is looked as a social reality, not as religious dogma and state preposition. Pluralitas seperti ras, etnis, agama, dan isme-isme (aliran) adalah sunnatullah yang keberadannya tidak bisa dihindari. Maka dari itu, munculnya aliran-aliran keagamaan, berdasarkan bukti-bukti sejarah, adalah bagian dari pluralitas agama. Dalam hal ini, untuk menjelaskan hal tersebut, tulisan ini mencoba untuk menekankan perlunya kesadaran semua orang akan keberadaan pluralitas aliran-aliran keagamaan sebagai bagian dari sikap inklusif terhadap pluralitas tersebut. Jika hal tersebut bisa dilakukan, maka masyarakat akan bisa membangun dialog konstruktif dan munculnya aliran-aliran keagamaan yang berbeda di masyarakat tidak akan menimbulkan konflik berdarah, melainkan akan melahirkan rahmat bagi umat manusia.Key words: dialogue, distinct sects, inclusive-pluralistic, sunnatullah.

Condemning New Religious Streams: A Problem of Making a Civilised Umma

The rising of the religious sects that are claimed as deviated and infidel has been a controversial issue today. This paper reviews the phenomenon, both from the basic of Muslim’s faith and from the historical context. Based on these perspectives, this article analyzes the phenomenon of the religious sects vis a vis major groups of Islam. This phenomenon can be categorized into two perspectives; first, the sects which are claimed as deviated can be categorized as madzhab in Islam. Second, those sects can also be indicated as new religion. From the mainstream Muslim group side, the sects was not admiited both as madzhab of Islam and also new religion, because they believe that there is no true religion but Islam. Therefore, all these sects will be refused and should be destroyed. Here, Muslims are not able to make the norms of living together and harmony.In fact, Islam teaches freedom of speech, thought, and faith. Every one can choose anything without any pressure. To overcome their daily problems, they have to have sense of humanity and non-violence attitudes.Keywords: deviating, streams in Islam, problems, and civilised society

Law Enforcement on Blasphemy Offense (Study case on Lia Eden Community, Yusman Roy and Ahmadiyah )

This research attempts to analyze the argumentations or factors which are used by government to criminalize heretical sects in Indonesia and their relation to the freedom to perform devotional acts in accordance with one’s religion or belief. This is a normative-juridical research, under the consideration that the standpoint of the research merely analyzes laws and regulations on heretical sects. However, the library research has been conducted not only on laws and regulations in Indonesia but also some legal provisions on blasphemy from many other countries. Based on the analysis in this research, the result shows that parameter used by the government to criminalize the adherents of the heretical sect in Indonesia refers to the provision article 156b KUHP. The three cases studied in this research are Lia Eden, Yusman Roy and Ahmadiyah, proven to commit blasphemy. To support the argumentation of article 156a, the panel of judges confirmed various evidence including the opinion of the pre-requested qualified expert of religion.Keywords: blasphemy, law, belief, and human rights.

Academic Underground (A study of Biro Bimbingan Skripsi (BBS)/ Thesis writing advice bureau in Daerah Istimewa Yogyakarta)

The current research analyzes the background of the emergence of a non-official Biro Bimbingan Skripsi (BBS)/ Thesis Writing Advice Bureau. The research maps the patterns of the services, and recognizes the characteristics of students who use this service. This research used dependent variable, independent variable, and moderating variable. Data were gathered through surveys, participatory observation, depth interview, and field notes. The data were analyzed using coding method, matrix analysis, event index filling, conceptual-cause formulation, and conclusion validation. To find the sources, the researcher investigated BBS advertisement in the newspaper, internet and informant. The researcher also did interview with wide range of informants, from the officers of BBS to students who use the BBS service. Sampling method in this research used accidental sampling, while conclusion was examined with cross-case and triangulation method. This research finally found that (1) thesis writing supervision in almost all of campuses is not effective and there is no clear scheme of financing in thesis supervision process, (2) BBS service known for its capability, easiness, and guaranty, and by that, BBS service is hugely demanded; (3) the characteristics of BBS service users are: from Jogja region, from private universities, non-engineering program students, participants of regular/ extension/ long distance program, last phase of study (student who stands in semester 6 – 9 and or will be DO), and students who works/ who are employees.Keywords: thesis, university student, campus, BBS

Fatwa Majelis Ulama Indonesia (MUI): On Ahmadiyah

In the end of 2007 and the beginning of 2008, the Ahmadiyah again became an important issue in Indonesia. Similar issue appeared in 1980 and produced a fatwa on it by the Council of Indonesian Ulama. This short paper describes the basic reason why the majority of Muslims in Indonesia oppose the existence of the Ahmadiyah. To analyze the problem, the theory of clustering Islamic teachings is used. Nasr Hamid Abu Zaid, for example, divides Islamic teachings into three levels; the original text of Islam, interpretation, and the teachings practiced by Muslims. Similar theory is formulated by Abdullah Saeed. The result is that the basic reason of the opposition of Indonesian Muslim to the existence of the Ahmadiyah is its belief of the status of Mirza Ghulam Ahmad as a prophet whereas according to the belief of majority Muslim, Muhammad is the last prophet. Therefore, the best way to solve the problem is a declaration or a recognition that Ahmadiyah is out of Islam. The emergence of religious sects has caused fidgetiness among society, ether in religious community itself or in social interaction in general. Historically, the emergence of religious sects takes place through times and centuries. It emerged by the time the religion was born. In Islamic history for instance, it has been widely known that there are genesis of the sects of khawarij and syiah in the phase of shahabah (companion of the Prophet Muhammad). Recently, in Indonesia especially, some sects considered as deviated, such as Jamaah Ahmadiyah, Al Qiyadah Al Islamiyyah, and Quran Suci have emerged. This has caused strained situation among society. In many regions, people massively protested against the existence of the sects. Often, it was followed by damaging the properties of the sects, such as houses and mosques. This article describes definition and characteristics of religious sects, whether it is good or deviate. This article also elucidate the causal factors of the emergence of those sects as well as its impacts toward society’s life. The study shows that the right sects are those who persistently hold the norms and values of Al-Qur’an, Sunnah, and follow the behavior of the Companion. While the causal factors of the religious sects emergence include economic factor, political factor, and the divergence of way of thinking. The impact of the emergence of those various religious sects are aqidah divergence, political movement divergences, and adhering strictly to the sect and ignoring strictly to the others. This is such as Mu’tazilah differs fundamentally from Ahlussunnah wal jamaah, Khawarij differs from Syiah, Qadariyah differs from Jabariyah. Each sect claimed that its opinion is the truest and others’ is wrong or astray.Keywords: religious streams, causal factors, chracteristics, and social impact.

A. R. Fakhruddin: The Face of Tasawuf in Muhammadiyah

With emphasizing to truth Islam and refusal to taqlid, bid’ah and churafat, Muhammadiyah has appreciation to Islamic mysticism (read: akhlaki Islamic mysticism). Although Islamic mysticism is more individual necessity and the term has never been mentioned, but many of Muhammadiyah figures practice Islamic mysticism individually. It was began from founder of Muhammadiyah, K.H. Ahmad Dahlan and others figures, such as: Ki Bagus Hadikusumo, K.H. Mas Mansyur, Buya Hamka, AR.Fakhruddin,etc. A.R Fakhruddin him self can be addressed as Kadda an yukuuna Suufiyan (near to be a Sufi), in this case Sufi Akhlaqi. It is caursed by all akhlakul karimah characteristics have already mixed up in his soul, such as: patient, thank God, Wara Zuhud, Qana’ah, Tawwakal, Ikhlas, Risha, etc. In the meantime, his spiritual life which fills more of his life and it is reflecting Islamic mysticism attitudes. A Sufi’s live can be reflected from his attitude and thought about: taubat, taqarrub, dzikullah, khusyu’, tawaddhu’, khauf, raja, muraqobah, and istiqamah, these maqam are common to be done in Islamic mysticism world. The appearance of the modernity has resulted in many revolutions on human lives. Since the intervention of highly modern devices in communication, for instance, we find multitude of ways how humans express their will to get in touch with one another in extremely unimaginable manners long time ago. This has much benefited people for they are getting easier to do and get everything in this modern world. Nonetheless, not only does this results in merely positive impacts, but there we also find how modernity has overshadowed many worldly traditional norms and, in some degrees, has made them blurred in daily relation. Basically, those ’traditi¬onal’ norms function as a code of conduct for human to mirror their deed so that the broke of this worldly life can be avoided. In this sense, it will be interesting when we relate The West and Islam in announcing the salience of a norm and its values in daily modern lives. Interpretation of Verses on Consumption (Application of Quranic Economic Tafsir)

This essay tries to develop economic studies from the point of view of Quranic economic tafsir. As a methodology, tafsir plays significant role in order to develop Islamic economic discipline. This model of economic tafsir derived from the thematic Quranic interpretation is developed through four phases including; classification of Quranic verses pertinent to economic affairs, understanding them based on chronology, micro and macro context, and socio-economic contextualization. The Nature Of Riba In Islam

Perdebatan masalah riba seperti tidak pernah selesai di diskusikan oleh banyak kalangan, baik akademis, organisasi keagamaan, bahkan sampai pada forum-forum intenasional. Beberapa terminologi dibahas dengan baik dalam tulisan ini yang dimulai dengan pelarangan riba itu sendiri kemudian pembagian-pembagian riba, diantaranya riba al-Nasi’ah dan riba al-Fadl, serta implikasi dari dua bentuk riba tersebut. Pembahasan didukung dengan pendapat-pendapat para ulama dan ekonom yang merujuk langsung dari ayat-ayat al-Qur’an, sampai pada perdebatan hukum. Demikian juga al-Qur’an sangat jelas membedakan antara riba dan perdagangan, namun pelarangan riba sangat jelas bahkan diperkuat dengan hadits-hadits yang dengan eksplisit melarang riba. Dijelaskan pula tentang perbedaan antara riba dan bunga bank. Islam sangat menentang bunga bank karena Islam berharap terjadinya sistem ekonomi yang mengeliminasi seluruh bentuk ketidakadilan dengan memperkenalkan keadilan antara pengusaha dan pemilik modal, yaitu berbagi resiko dan berbagi hasil.

The Need Of Muslim Floating Market for Bank Syariah: A Case Study of the Member of Pengajian Bisnis al-Kautsar NU in Special District of Yogyakarta

Entrepreneurs of NU, engaged in the al-Kautsar religious gathering, can be deemed as having good education and structural position either as a member or an organizer. They declare that NU institutionally gives a big contribution to their business. Their companies are generally home-industries in which they themselves pay the capital. Though the profit is less than IDR 5,000,000, they are aware of developing their industries. Their participation in the Islamic organization, NU, does not mean that they do not choose the conventional banking system, not the shariah one. Their choice is based upon a consideration which banking system is more beneficial for them. To put simply, it can be said that they will be enthusiastic and interested in utilizing the services of shariah-banking system if they could get more benefits. However, they prefer interest system than profit-sharing system. They consider both systems as being at the same position and regard interest as religiously acceptable. Therefore, they believe that conventional banking system is allowed in Islam. The contemporary crisis of global financial, then economic, systems usually analyzed, interpreted, and perceived to be solved based on variables from within these two systems. In such frame of thinking, financial assets and leverage, mortgage crisis, stock markets, etc are proposed to interpret the crisis, leaving behind many other vital variables. Vital variables are those of epistemological, axiological and ontological systems that form and guide the financial and economic actors in capitalist-globalized system. Through two methodological introductions, this article, this article proposes the contemporary crisis as an aspect named ‘economic’ of another deeper, more influential, and circumambient; which the article named “Al-’aâlamîn Contemporary Crisis”. In the first introduction, the article suggests that those ‘economic actors’ are simply men and women, who live complex and multi-dimensional gross story. Such complex gross story cannot be dealt with (analyzed, interpreted and solved) except through a complex model (Fiqh), which budges ‘economy’ from the center of humanity experience that live a dialectic (and many times conflicts) among its various elements (natural and supernatural) heading to perfectibility, even will not achieve it absolutely. The Application of Islamic Business Ethics in The Contexts of Producer and Consument: Toward Corporate Social Responsibilty

In fact, business activities neglecting ethics harm consumers and employees as many cases occurred in this country i.e. formalin case, little wage, oil stealing in Kalimantan, industrial cesspool, transaction of stolen wood, etc. Such facts and cases, to ethical perspective, are due to separation between ethics and business which has a negative impact on human lives. But, ethics and business are two entities being able to be united as one. According to Islam, business is not only an activity to get financial profit, but also the activity to attain essence of humanity as implementation of which becomes human responsibility as creature and caliph in achieving Allah’s favor. Therefore, Islam teaches values of business practice such as unity, freedom, responsibility, equality, virtue, and honesty. It is a valuable teaching that all parties such as producer, consumer, employer, employee, and society must apply business ethics, because this does not only deal vertically with producer’s responsibility, but also with existence of business activity itself. To put simply, mutual and harmonious relationship among involved parties in business activity will be constructed, if values of business ethics are held as fundamental source for their business practice.Keyword: ethics, business, human responsibility.

The Understanding of BMT’s Practitioners of the PSAK No. 59 (The Accounting of Shari’ah Banking) on The Recognition and Measurement of Funding Products

The objective of this research is to explore BMT practitioners’ understanding of the SPAK No. 59 on the Accounting of Shari’ah Banking for funding products. For this reason, the research is conducted by descriptive method. Field research using quantitative approach is also used. However, qualitative approach is also used to explore and to clarify as well as to compare between the concept and the real situation. The population used in this study are members of PUSKOP¬SYAH DIY, and the subjects of this research are the managers and accounting staffs of these BMTs. The sample consists of 30% of 80 active members. However, since the magnitude of each sub-population is different, proportional sampling method is used to determine the number of sample taken from each sub-population, and purposive sampling method is used as the sampling method. The independent variables used in this research are age, educational background, length of time working in BMT, and frequency of training or workshop joined by the subjects. Meanwhile, the dependent variable in this research is the BMT practitioners’ understanding about SPAK No. 59 for funding product. Data gathering methods used in this research were questionnaire, field observation and interview. Meanwhile, data analyses for this study include descriptive statistical analysis and inferential statistical analysis. Keywords: accounting, PSAK No. 59, understanding, practitioners of BMT

The article discusses the role of public Islamic finance institution viewed in the context of economic public endeavor. This problem emerges in public because the public Islamic finance institution in Indonesia does not take in part proportionally yet to create public prosperity in Indonesia whereas the research of the Language and Literature Center in UIN Syarif Hidayat¬ullah and Ford Foundation results that the potential of funds (Zakat, Infak, Shodaqoh) and donation of Moslems in Indonesia (IDR 19.3 billions) managed by the public Islamic finance institution can be used for people prosperity. Besides, it is supported with the big number of Moslems in Indonesia. Therefore, there are two important things to be focused on this article. First, Why has the fund in the Islamic Public Finance Institution such as ZIS and endowment in Indonesia not played optimal yet in creating social welfare? This article tries to explore the possibilities of tasawuf ethic application to actualize Good Governance in Indonesia. The study focuses on some arguments why tasawuf and al-Ghazali are selected as the main discussion. The arguments are that Tasawuf is an Islamic tradition and al-Ghazali has capability for it in terms of his social lives. He proposed three concepts of thought concerning tasawuf ethics, that is, zuhd, teleological ethics, and ummahat al-fadhail. Bureaucracy and the Culture of Rational-Egalitarian Structure: The Contribution of Religion for Strengthening Good Governance

The role and function of religion recently in the government system seem to have problems because of the believers itself. The fact shows that in the government order that is led by most righteous people, the management indicates various deficiencies, such as inefficiency, authority abuse, collusion, corruption, nepotism, and society’s cooptation to support the political party of the regime. Therefore, to improve the order, it cannot be subjected to the religion believers only, without strengthening the good governance. This last statement requires knowledge, attitude, and action of the public service officials. Furthermore, this is a step of improvement of political abuse, including bad performance of bureaucracy. The article tries to highlight the significant role of religious consciousness relevant to the development of good governance. Good governance will be well-implemented, if each takes part actively, together with government, in developing community’s understanding on the importance of rational-egalitarians in the government system. It is also required a firmness of moral principles and ethic awareness of all public service officials and society to execute the good governance in the government system.Keywords: bureaucracy, religion, irrational-hierarchical and rational-egalitarian

People in Good Corporate Governance: Position, Relation, and Civility Scheme

The relationship between state executor, business actor, and people or social order that enter Good Corporate Governance and Corporate Social Responsibility on an agenda is not necessarily in a mutual accord. This paper offers three schemes in strengthening the position and relationship of the people or social order among other stakeholders. First is the attitude toward neo-liberalism, which is the scheme to prepare the people or the social order using future research in managing the future. Second is the scheme of democracy choice that has been a must in the reason economic-politic conditions. Religious Splinter Movement from Historical Perspective

This article tries to analyze splinter groups of Islamic religion in Indonesia. Islamization in Indonesia has been building in the framework of universal values that containes democracy, i.e. hifdz-din, hifdz-nafs, hifdz-nasl, hifdz-mal, and hifdz-aql. Political change occurred in 1998 had triggered the emergence of splinters of Islamic religion; they were Salamullah, Isa Bugis, Baha’i, Madi in Palu, Qur’an Suci, and al-Qiyadah al-Islamiyah. They used atmosphere of pluralism and inclusivism to form their splinters’ community of religion. But, Ahmadiyah in historical perspective is different, because Ahmadiyah had existed before Indonesian Independence, and took part in resisting against Western colonization. The believe code of splinters of Islamic religion are deviant. They do not accepted Muhammad as the last prophet, change ‘shahadat’ and ‘shalat’. However, some people do not agree to punish or accuse them as being “sesat (deviant)”, because there still some chances to conversion.Keywords: Islam, doctrine, democracy, splinter group or movement, and violence.

This paper discusses about the formalization of Islamic shari’a in public policy area in Indonesia. The writer will use a pluralism of political perspective to discuss this paper. In pluralism of political approach in public policy, there several questions will guide a writer in this study. The important questions in pluralism of political approach are; who engaged in the process of decision-making; who’s choice that accepted as a decision; and who can put up influence to the outcomes. After we discuss wide range a concept of pluralism of politics and public policy, this paper will study a discourse and the aspiration of Islamic shari’a; formalization from district level until central level and the minorities’ response toward public policy that oriented to special religion. This paper, systematically, will begin from the perspective of pluralism of politics to examine many problems that discussed and will be finished with the conclusion.

Some Malaysian people has repudiated their country as an Islamic state. At the same time, the other people, especially Muslims, asserted that Malaysia already is and ought to be regarded such. The participation of Malaysia in Organization of the Islamic Conference and the enactment of syari’ah in its law system has evident in it self. From the discourse of Islamic politics, however, the Islamic state is not a monolithic concept. Interestingly, after the Pakatan Rakyat won many seats in parliament in 2008, politicians has paid attention on welfare state issues, not Islamic state, as a common denominator between Islamic party and secular party that has made a shared coalition to be an alternative from the National Front.

The resurrection of religions was back felt since the early 90s. Even, the philosophy that overshaded under jargon “post-metaphysical” began to take an interest in religious issues. Juergen Habermas who called himself “religioes unmusikalisch” (not religiously gifted) made the relationship between religion and rationality in post-secular society as a main theme of his philosophical studies in recent years. Habermas built his theory upon Kantian’s thesis and criticized Kant who did not give a clear line of demarcation between religion and reason. By using an analytical tool of Schleichermacher and Derrida, this paper rejects the Habermas’ thesis and shows the close relationship between faith and reason. This paper uses method of literature research by referring to the Germanic original works of Habermas and some comments on it.

The relationship between religion and the state becomes a crucial issue among scholars. On the one hand, there is no relationship between religion and state, and vice versa religion and state has no significant relationship. This issue is being debated for the Islamic community itself, because there is no teks that requires forming in Islamic countries, thus opening the door of ijtihad. Indonesia, as the world’s largest Muslim countr y Indonesia does not need to be demanding an Islamic state, what matters is the substance and essence-its essence, not a very formal form symbolists. Pancasila as the state problem is formulated by the leaders of Indonesia which largely Muslim. Basically, Pancasila not contradictory, but inline with Islam. Even the precepts of Pancasila depend on it are the basic teachings of Islam.

Penelitian kualitatif ini untuk menjawab (1) pengetahuan dan tatanilai warga sebelum dan sesudah letusan Merapi 2010; serta (2) konvergensi dan divergensi pengetahuan dan tatanilai warga setelah letusan Merapi 2010. Penelitian ini merekomendasikan, pertama, dalam hal pengambilan sikap dan tindakan, warga cenderung merujuk sumber informasi dari pemerintah, pengamatan fakta lapangan, dan mempertimbangkan pencerapan pribadi (mimpi atau yang lain). Dibutuhkan kajian tentang transformasi sosial dari sejumlah kearifan lokal. Kedua, kebutuhan untuk merumuskan posisi dan peran agama dalam kondisi bencana. Dibutuhkan pembelajaran agama yang menggugah untuk menjawab permasalahan warga. Ketiga, ketidakoptimalan pemerintah desa untuk melayani kepentingan dan kesejahteraan warga merupakan gambaran dari kebijakan pemerintah tentang otonomi desa. Peranan tersebut ter gantikan oleh LSM. Abdurrahman Wahid introduces a socio-cultural approach to deal with the issue of the relationship between Islam and state. The approach is a kind of modification to the Fiqh approach advocated by Nahdhatul Ulama (NU) to suit it to the development of modern sciences as well as to understand the latter based on Islamic cosmology. According to him, Islamic identity is Islamic cosmology which views the spirit and the material intermingling in the worldly life. Accordingly Muslim should respond to the issues of modernity based on this Islamic tradition with the hope to direct the modernity discourses. By so doing it will help to mediate the conflict of ideologies based on its belief that “the normative” intermingles with “the particular” and as consequences there is no absolute truth prevailing in this worldly life.

The discourse of Islamic state and the implementation of the sharia (Islamic law) has been an endless issue to be discussed. This issue is still debatable for various parties. In one sense, it is accepted and even supported. In other sense, it is blasphemed and criticized. In the reality of global politics, the efforts to establish Islamic state and the implementation of the sharia has been practiced by many Islamic countries including Indonesia. This paper tries to explore Ahmad Syafii Maarif ’s thought concerning the discourse of Islamic state and the implementation of the sharia. Ahmad Syafii Maarif refuses the efforts to establish Islamic state and the implementation of the sharia by unconstitutional and undemocratic ways. He criticizes people promoting the discourse. Besides theological and historical reasons, he argues that the discourse will have no benefit. In his perspective, Islam is adequately positioned as an ethical foundation of nation.

Pendahuluan: Dalam kenyataan sehari-hari tampak aneka peristiwa cuti otak telah wujud, merambah ke mana-mana dan menjadi fokus berita yang sering dikaitkan dengan dinamika peran bermakna mass media. Kenyataan pahit ini menjadi sejenis cuci mata bagi umumnya warga masyarakat yang telah jenuh dengan beragam kendala hidup sehari-hari. Mereka menghadapi aneka kesulitan sekedar mencari sesuap nasi untuk dirinya sendiri, apalagi keluarganya. Belum lagi kesulitan apabila mereka harus mencari tambahan biaya untuk sekolah anak-anaknya. Apabila mereka sakit, kesulitan makin bertambah sekedar untuk berobat hanya masalah berbelit birokrasi. Keadaan makin bertambah rumit apabila mereka miskin, apalagi bila tak punya uang. Saat berkendaraan mereka juga mengalami beragam kesulitan karena banyaknya polisi tidur. Bagi mereka polisi tidurpun sama mengganggu apalagi bila melek, terjaga. Sementara sebagian aparat terkait biasanya cenderung cuci tangan. Kenyataan ini mengu-atkan saling berkait antar pasar, negara, masyarakat, dan media. Sayang semua ini belum mampu melahirkan pengamalan demokrasi secara utuh dan menyeluruh. Peristiwa-peristiwa apakah yang telah menjadi santapan cuci mata dan aneka pihak terkait ramai-ramai sama cuci tangan? Sebelum dijawab, ada baiknya dikaji kutipan berikut: Kalau Anda ingin orang Islam marah, bakarlah masjid! Kalau Anda ingin orang Kristen marah, bakarlah gereja! Kalau Anda ingin keduanya saling serang, bakarlah masjid dan gereja! (Machiavellisme)

This article is about religion, conflict, and multiculturalism with a case study in Surakarta. During this interpretation of religious doctrine by some regarded as a trigger the birth of a number of horizontal conflicts. Moreover, several regions in Indonesia known as a regional base for adherents of certain religious fanatics, such as in Surakarta, where the power of Islamic and Christian faiths are equally strong. Therefore, this article produced important findings about the need to develop multicultural awareness within the Unitary State of Republic of Indonesia.

CORAK PEMIKIRAN DAN METODE IJTIHAD IBN TAYMIYYAH

This article discusses the thought color and methods of ijtihad of Ibn Taymiyyah, one of the most influential figures in the movement of of Islamic thought renewal. He raised a number of criticisms of the logician. The arguments he used indicated that he is a thinker of empiricism. This empiricism complexion coloring intellectual works in various fields. In the field of fiqh, in the beginning he was a follower of the school of Hanbaliyah, however, in further development he performed ijtihad independently without being tied down by other schools. That is why Ibn Taymiyya was known as a mujtahid mutlaq. Although in performing ijtihad he remains grounded in the Qur’an and Sunnah as well as admits the ijmâ’ and qiyâs as a source of Islamic law, his thoughts are often different from other scholars of his time, both on the aspect of methodology and the results of his ijtihad.

IMPLIKASI TEORI PEMBELAJARAN JEROME BRUNER DALAM NUANSA PENDIDIKAN MODERN

Jerome S. Bruner is one of the best-known and influential psychologists of the twentieth century. He was one of the key figures in the so-called ‘cognitive revolution’ - but it is the field of education that his influence has been especially felt. His books The Process of Education and Towards a Theory of Instruction have been widely read and become recognized as classics, and his work on the social studies programme - Man: A Course of Study (MACOS) - in the mid-1960s is a landmark in curriculum development. More recently Bruner has come to be critical of the ‘cognitive revolution’ and has looked to the building of a cultural psychology that takes proper account of the historical and social context of participants. This theory needs to be analyzed which gives some information of cognitive development of the student in teaching learning. Theory not only talks about cognitive but also affective and psychomotor. All of these aspects have been included in teaching learning process, so the teacher have to be responsible to apply these process well. Based on the statement above, the writer is interested to discuss about cognitive concept, applied in teaching-learning process in this era.

Kritik Nalar Tafsir Syi’ri

The article exposes the critique of Thoha Husein on the logical reasoning of syi’ri tafseer commonly used by several tafseer experts, such as al-Zarkasi, al-Suyuti, and al-Thabari. The logical reasoning of syi’ri tafseer developing until today states that Al-Qur’an was descended using Arabic language in which some of the verses refer to the Jahiliah syi’ir that existed in the Arab community at the time. Thoha Husein criticizes on the opinion. His argument is on the authenticity of jahiliyah syi’ir, not on the urgency of its usage to understand difficult words of Al-Qur’an. According to him, those are not really jahiliyah syi’ir, but they were made by plagiarists during Islamic era for hidden interest.

Nilai-Nilai Moral Islami dalam Serat Wulang Reh

The article elaborates the Islamic moral values on Serat Wulang Reh. The Serat is one of works of Ingkang Sinuhun Paku Buwana IV containing moral education for Javanese society based on Islamic insights. The work contains wulang (read: advice) toward family and society at the time. Although it refers to the time, this serat can be reviewed. Since the sources of the serat are from Al Qur’an and Hadits, its values are useful as learning sources and moral guidance for future generation.

Fenomena Tradisi Megengan di Tulungagung

The study is a qualitative research with phenomenological approach. It explored the phenomena of megengan tradition in Sumbergempol Tulungagung, and especially conducted in three villages, i.e. Bendiljati Kulon, Sambijajar, and Tambakrejo. The findings show that; first, megengan tradition is only executed on the last ten days of Sya’ban /Ruwah month. On the last development, megengan tradition has moved into various forms and ways, as shown in the megengan tradition occurred in Sumbergempol Tulungagung. Second, the tradition has been changing in its forms such as its time, place, volume, and funeral visit tradition.

Karya sastra memiliki peran tersendiri dalam sejarah perkembangan peradaban manusia karena sifatnya yang lentur sehingga dapat menjadi media penghubung garis batas antara agama, ilmu pengetahuan, mitos dan kebudayaan.Tulisan ini mencoba menggali semangat hijrah Nabi Muhammad SAW di dalam dua buah karya sastra fenomenal yang menampilkan seorang muslim sebagai tokoh utamanya, yakni V.S. Naipaul’s A Bend in the River and Naguib Mahfouz’s Zaabalawi. Peristiwa hijrah Sang Nabi yang sarat hikmah telah melahirkan ragam interpretasi. Di dalam tulisan ini, hijrah dimaknai sebagai peristiwa berpindah dari suatu tempat atau keadaan menuju ke tempat atau keadaan yang lebih baik dalam upaya menggapai ridho Ilahi.

How to manage this reality is a longlife problem.One of the efforts is empowering the role of religion. The role of religion in realizing multiculturalism in Indonesia can be reached by building mutual awarenes through the efforts of multiculturalism consciousness transformation into a national identity based on the reality of plurality in Indonesia. The Unity in Diversity as an ideal text always need to be read at any occasion because, in principle, the identity is never final. Likewise, efforts to build a national integration based on multiculturalism by encouraging public awareness using their constitutional rights to assembly, association, and expression in order to fight for the rights of justice, liberty, equality, and actively participated in the development.

Materialisme, konsumerisme, dan individualisme dikampanyekan berasal dari Barat dan mengancam karakter moral masyarakat beragama, terutama kaum muda dari berbagai penganut agama. Benarkah demikian? Perlu dicatat bahwa globalisasi berdampak luas pada identitas budaya dan agama, namun tidak berarti selalu bermakna dampak negatif dan disintegrasi. Globalisasi dapat juga memiliki efek memperkaya, memperkuat dan membuat budaya lokal lebih fleksibel. Untuk itu perlu dicarikan metode dan mekanisme yang menjadikan globalisasi berdampak positif terhadap identitas suatu agama, terlebih lagi, memang beberapa agama berasal dari sumber yang sama, yakni agama yang dikenal dengan abrahamic religion (Islam, Nasroni, dan Yahudi).

Individual identity in politics is not a trivial matter. Identity is a signifier of meaning attached to a group. A Chinese politician will have a different symbolic meaning to majority of Indonesian people that considered him as foreigner. A similar case also occurred in the United States thata president is not only a leader of state and commander in chief during the war, but also as a symbol and ambassador for the country and the people who choose him. So that, it is feared that a leader from the minority is not able to become a symbol for the identities of the majority. Similar to Indonesia, a leader is expected to become a symbol for religion, ethnic, and tribal majority in the electoral area. However, with the current political developments, politicians from minority groups will have an “angel helper” because of the democratic system that separates religious affairs and public interest as well as the idea of equality and tolerance among religions.

Kristen memandang Musa sebagai salah satu pendahulu terbesar dari tokoh sentral dari agama mereka, di samping Yesus. Musa tidak hanya nenek moyang dan pendahulu, tetapi sebagai bagian model dalam kehidupan Isa. Injil Matius memiliki banyak referensi yang menunjukkan Musa sebagai model untuk Jesus. Musa tidak menjadi isu utama dalam perdebatan modern, oleh karena itu sulit untuk memilih satu atau beberapa ide sentral yang berhubungan dengan Musa. Meskipun demikian, artikel ini mencoba untuk menguraikan posisi Musa sebagai pemimpin yang disajikan oleh para teolog kontemporer di Indonesia. In the pre-independence era and towards independence era of Indonesia, muslims become a political force that taken into account, it means muslims have an authority to make a decision that influence the future of Indonesia. The position of muslim was continoued until the birth of the Old Order. In the era of the Old Order or Democracy Guided, about relationship between muslims and the state at the time, the Muslims devided into two groups of politicalpatterns, first ijtihad,it is better for muslims to get into the system for the sake of Islam, while second ijtihadrecommended that muslims must fight the systemfor the sake of Islam. In the era of the New Order, the relationship between muslim and state was very unique, which was cordial in beginning, conflicting for long time, and finally going into intimate at the end of the era.

POLITIK ISLAM DALAM PUSARAN SEJARAH SURAKARTA

This article tries to analysis political strategy at the time of islamzation in 16th to 19th century. This analysis use political theory, it’s descending and ascending of power. By supporting of the Saints, it’s possible for Jin Bun (Raden Patah) built the Kingdom of Demak, and by supporting not only spread of islamization, but also reinforced political and social structure. Implication of that Islam was possible running embraces in Demak society. Conversion from Hindu to Islam could be investigation by language symbolism, for instance, the title of Ngabdurrahman Sayidin Panatagama Khalifatullah. Although the Kingdom of Demak had been collapsed, but islamization processes moved to Pajang and than to the Palace of Mataram. Furthermore Sultanate of Mataram, Sultan Agung, introduceda new strategy for spread of islamization in Java, that were: (1) palace as center ofIslamization, and (2) Islam center points of Javanese culture. The new strategy were continued of political strategy of the Saints. In the other side, Sultan Agung supported the Saints to built pesantren or madrasah (local boarding school) that had been a grassroots political legitimation. And a grassroot power based on values of solidarity or ashabiyyah.

The article below attempt to analize the influence of Indonesian politics to the development of islamic economics practices in Indonesia, especially situation and condition of Indonesian politics in the New Order Era and the reformation era. The article find that the influence of situation and condition of politics transformed in Indonesian political economy oriented to Islamic economic system in developing Islamic economic practice is very signifinace. Politics of the New Order Era bounded the development of Islamic economic practice. Politics of the reformation era supported the development of Islamic economic practice. It was proven by a rapid progress of Islamic economic practice in the area of Islamic banking, Islamic insurance, Islamic capital market, Sukuk, Islamic unit trust/mutual fund, Islamic microfinance institution, and Islamic public finance in the reformation era because of political condition and situation support.

Character education is getting the most attention from formal schools in Indonesia after the government announced that it is important to build the younger generation’s character. The character development is very important because many crimes are committed by high school students such as fighting, drug abuse, and motor-gang fights. This study aims to describe the implementation of character education in Madrasah Aliyah Sunan Pandanaran, which is a boarding school under Pondok Pesantren Pandanaran, and design character-education patterns suitable for MASPA. Descriptive qualitative research design was implemented by interviewing teachers and management staff at MASPA and observing the implementation of character education in MASPA. The results showed that 1) MASPA has been implementing character education in the 9 main character values namely religious character, honesty, tolerance, discipline, hard work, self-reliance, self-confidence, responsibility, and patriotism. 2) the implementation of character education is integrated with the regulations at Pondok Pesantren Sunan Pandanaran. Each character is developed with different activities. Some of the activities that are required leads in sanctions if it is not carried out by learners or students. 3) The suitable character education model for students of Madrasah Aliyah Sunan Pandanaran is by example. Nonetheless, implementation guide should be recorded so that it can still be implemented under different management. A design of good character education is also presented for MASPA.

This article is intended for developing the foundation of multicultural Islamic education in accordance with the identity of Indonesia nation. This article reviewed the meaning contained in Q.S. Al-Hujarat (49): (11-13), often related to groups of verses proposing the multicultural spirit in a life. These verses were then examined by refering to the comprehension of Indonesia tafseer expert in Tafseer Marah Labid, Tafseer Al-Azhar, and Tafseer Al-Mishbah. Those three tafseers composed by Indonesian authors are expected to be able to represent the peculiarity of Islamic experience in Indonesia. the result of the discussion towards the meaning of the verses indicated that the multicultural spirit was recognized as an important part in dynamics of the teachings of Islamic since it is inevitability. If it is associated with the multicultural education, the spirit of teachings of Alquran needs to be developed by reinforcing multicultural visions in Islamic education in Indonesia, begun with the content and the development of government policy.

Islamic University of Indonesia (UII) was established by the founding fathers who originated from the background of several Islamic organizations in Indonesia. such as Nahdlatul Ulama (NU) and Muhammadiyah, etc. so that the vision of UII, is rahmatan lil ‘alamin. Starting from this vision, then this research traces Islamic reason of UII lecturers. The theory of Islamic reason that used in this research is by integration the theory of Mark Woodward, Peter G. Riddell, and Kuntowijoyo. Having done the research process, and the classification of two typologies of UII lecturer faculty of exact and non-exact. The result of this research has revealed that Islamic reason of UII lecturers of exact faculties tend to be classisfied into Modernist Islam and lecturers of nonexact faculties can be regarded as Neomodernism Islam.

This research background arouse from the problems found in the Pendidikan Agama Islam (PAI) or Islamic Education learning process in SLB Bhakti Kencana, Berbah, Sleman and in other extraordinary primary schools in general. The researchers assumed that the curriculum performed in PAI learning in the school did not suit for disabled students. The competency standards for the school are exactly the same with the standards for ordinary students. The difference between the ordinary students and mental retardation students is greatly clear, namely “IQ competence.” Collecting several aspects of that problem, the research aims at overcoming the problem by employing a strategy to optimize the instructional materials as the accomplishment of the competency standards of PAI for the mental retardation students in the first grade. The problem was formulated to answer about how to design effective instructional materials for the first-grade mental retardation students in extraordinary school. This research was conducted by applying Research and Development model. It could be concluded that the instructional materials which were fit for the students should have (a) began with easy to tough topics, concrete to abstract, simple to complex, (b) been suited to the students’ personality and ability, (c) emphasized the functional skills, and (d) been interesting. The developed module included more complete steps, so it could facilitate the students to learn. The feasibility test showed that the developed module (1) was good in the feasibility contents, (2) was good from the aspects of the language and illustration, (3) was good observed from the presentation aspect, and (4) was very good in the module layout since the module had the balance between the text and illustration, the size of the picture, the font, the interesting cover, so the students could understand the module easily.

This research aims at finding out the dilemma occurring in the political education, performed by the organization named Gerakan Jemaah Tarbiyah. A qualitative approach by critical analysis was employed, and the data was gathered by documented and in depth interview methods. The result explained that; first, political education in a phase of the missionary movement could influence Jemaah Tarbiyah in transforming the movement by transmitting various knowledge, attitude and political awareness that Jemaah Tarbiyah had. Second, there was a political education trend which already shifted the roles as the indoctrination instruments for the party to transmit values and justifier various policies decided by the elite of the party.

The following article denotes the result of research. It tries to explain the curriculum and competencies of graduation that have been produced by Islamic law program in three Islamic universities of Yogyakarta , the State Islamic Universitas Sunan Kalijaga (UIN SUKA), Universitas Islam Indonesia (UII) and Universitas Tjokroaminoto (UCY). The research has been conducted by tracing documents and interviews with stakeholders in the three- universities. The results of this study has revealed that there are dynamics of the learning curriculum of Islamic law in three universities of Yogyakarta. The Competence of graduation from the curriculum of Islamic law is the result of the application of three universities of Yogyakarta can be categorized into two basic competencies both academic competence and professional competence. The basic of epistemological bases of Islamic jurisprudence in three universities of Yogyakarta still yet to be established form. Therefore, in order to produce the graduation, it takes the courage of stakeholders in three universities of Yogyakarta above mentioned to choose the alternative development of the study of Islamic law in the future.

METODE PENSYARAHAN SUNAN AN-NASA’I PERBANDINGAN ANTARA IMAM Al-SUYUTI DAN AL-SINDI

Many great scholars have emerged and presented various kinds of monumental works in the field of hadith. Their work became popular which was then called kutub assitah and a book contains almost all hadith from Prophet Muhammad SAW. The books were the main guide for fuqaha’, mujtahid, and other writers. The writers, educators, psychologists, and sociologists obtained what they needed from the books. Sociological and political condition had influenced a conducive situation to work in the hadith. Nowadays, there is diversification of science that distinguish one science to another. It is not surprisingly if many branches of science have emerged, such as tafsir, hadith, fiqh, languages, literatures, and others. This article reviewed the commentary method of Imam Al-Suyuti and Imam Al-Sindi towards a hadith book, Sunan Al-Nasa’ial-Mujtaba by Imam Al-Nasa’i (d. 303 H.). This review was limited to critically observe the comparison of the commentary method by Imam Al-Suyuthi and Imam Al-Sindy. Brief biographies of Imam Al-Nasai, Imam Al-Suyuthi, and Imam Al-Sindy were also outlined. Commentary by Imam Al-Suyuti and Al-Sindi towards Sunan Al-Nasa’i facilitated the people to understand and review. Though, both of them wrote very short commentaries, the commentaries have brought advantages for Muslims, especially for those who get involved and care about the study of Prophet Muhammad SAW hadith. This condition was actually a main purpose of writing those two commentaries.

This study discusses the Seh Amongraga’s moral teachings of Islam in Serat Centhini. Because of the breadth of Islamic moral teachings of the content delivered by various figures, then this study is limited in the moral teachings of Islam which was delivered by Seh Amongraga to his wife named Tambangraras. The results of this study are the moral teachings of Islam of Seh Amongraga’s moral philosophy is the realization of Java on the perfection of life sciences (ngelmu kasampurnan) as well as the science of the origin and direction of existing (sangkan paraning dumadi) which is the core of the moral philosophy of Java. Perfect life and behavior of guiding human thought in contemplating himself to find integrity in relationship with God. Origin and direction of human life that is guided and united in moving toward self-perfection of manunggaling kawula Gusti.

Business regarded as a battlefield. Plunging into the business means being ready to fight it out with the ultimate goal to reach benefit, even profit maximization. It does not mean giving tolerance to business activities deviated from ethics. Precisely ethics has a very strategic place in business. This research about Bugis moslem in Nunukan (its mean they are immigrant), that they achieved succesful in doing business as businessmen and traders. The results showed that religious and cultural background influence on the work ethic of Moslem Bugis in Nunukan North Borneo when they doing business. Their practical business related to the business activities practiced by the Prophet Muhammad, namely: honesty, discipline, and paying zakat and charity. Hard work is their effort to keep their self-esteem as identity of Bugis tribe.

The establishment and reinforcement of the workethic is not solely determined by the quality of education or accomplishments that related to the profession and the world of work, but also on faith that could be grown through worship. Rokan Hulu, an area in Riau, has arule for the Muslim employees to prayer in congregation. This legislations was poured in the regulations of the Regents of Rokan Hulu at no. 18 in 2011 about the obligation for Muslim Employees to pray Zuhr and Asr in the Pasir Pengaraian mosque. This research aims to influence the policy of the employee’s work ethic. Data collection was conducted by questionnaire and interview. From the beginning hypothesis, there is a positive influence from mandatory prayer in congregation’s policy against employee’s work ethic. Data were analyzed using Descriptive Analysis and simple linear regression analysis. A descriptive analysis of the results shows that most of the employee of the Region agree with the policicy and optimist this policy will impact positively on work ethic. Using simple linear regression analysis showed that the policy of compulsory congregational prayersfor 0.843 give a positiveaffect to employee’s work ethic in Rokan Hulu. These results are supported by the statements of religious Activities Sekretriat Kasubag Area of Rokan Hulu, Mr. Damrah s. Sos, that the application of mandatory prayer in congregation policy Zuhr and Asr is a step to build the employee’s moralenvironment in order to avoid fraudulent practices which are currently evident.

Their activities are characterized by uplift and empower the poorest people, to encourage wider participation, not bureaucratic and in need of a low cost, and many do experiment in community. The issue is how Non Governmental Organization (NGO) perform its activities and how the government response to the role of social transformation. To address this problem, theoretically use interactive theory, integrative of Gramcian and Community Development of Jim Ife and Susan Kenny. Discussion focused on the responses of government, as is often the activity of NGOs opposed to government policy.

Daerah Istimewa Yogyakarta province has a strategic position in developing creative industries. One of the districts that support these creative industries is Sleman. However, SMEs in Sleman district still largely prosperous, because they do not take more advantage of IT development to increase sales. The problems of this study, how to construct the marketingmodel for product of creative industries that adopted the principles of sharia marketing by utilizing the E-Commerce portal to increase revenues and competitiveness of creative industries in Sleman at the level of domestic market and international market. This research has produced an e-commerce portal (http://jogjakreatif.com) equipped with SMS gateway that enables traders of creative industries in Sleman to promote and conduct transactions with customers on line-based or sms. Through this facility, traders are not required to check transaction activity every time, but they can obtain latest information regarding transactions via email and sms.

The economic crises are occurred not only in the developing countries, but also in the developed ones. The signals provide a strong approval that economic based on capitalism and socialism has failed to create prosperity and to humanize the human-being themselves. Furthermore, Moslem countries which are the victims of both capitalism and socialism are getting sufferer, since they are trapped on foreign loan with high interest accumulation. Consequently, those Moslem countries cannot develop themselves, for their natural resources are more given to the developed countries as compensation and investment. The remaining is for foreign loan payment and is often corrupted. If collaboration is established based on a mutual interest, foreign hegemony towards the developing countries is not occurred. From this point, it is important to develop economy using the maqashid system which is planning and involving the substantial problem. The system proposes the investment loan must be used to develop productive sectors, such as infrastructure and facilities of education and training in order that the society has skill to live independent, and capable to improve their prosperity.

In this study, researchers focused on the legal considerations of the Supreme Court relating to wasiat wajibah that finally being jurisprudence. This study aims to provide an explanation of legal consideration basic used in the decisions of the Supreme Court in the case of wasiat wajibah. This study examines the consistency of legal consideration used by Supreme Court in the similar case, especially in the duration 2006-2013.

EPISTEMOLOGI AHLI WARIS PENGGANTI DALAM KOMPILASI HUKUM ISLAM

Kompilasi Hukum Islam (KHI) regarded as ijma of Indonesian ‘ulama fiqh schools were formulated through the study of the books of fiqh, interviews with scholars, jurisprudence and comparative study in Muslim-majority countries. Substantially, KHI includes legal reform, among others, the heir replacement in Article 185. The existence of substitute heirs still polemical, both in terms of the origin and validity. Heir rreplacement in KHI formulated through the jurisprudence derived from customary law derived from the Civil Code Napoleon in France. Substitute heirs grown in resolving inheritance cases, both at the level of the heirs, the level of customary deliberation and the judiciary. Results of this study showed that the presence of substitute heirs is a culture that is not based on faith, contrary to the principle of fairness, the principle ijbari, not in line with elements of inheritance and also contrary to the principle of the primacy and hijab. Heir replacement in KHI needs to be revisited.

ZAKAT LEMBAGA KEUANGAN SYARIAH SEBAGAI BADAN HUKUM

Normatively zakat of asset that must be payed is 5 kinds, namely: cattle, agriculture, trade alms, gold and silver, and rikaz. Some contemporary scholars like Yusuf Qaradawi, Ali al-Salus, Muhyiddin al-Ashfar perform ijtihad of Islamic law related to the development of various assets must be payed a zakat. Yusuf Qaradawi, for example, based on the results of his ijtihad, considering the realities of modern economic activity, he recommended nine kinds of asset that must be payed zakat. He added 4 assets, namely: honey and animal production, minerals and marine products, investment in plant, buildings, zakat profession, stocks and bonds. Furthermore, contemporary scholars also discussed the obligation of zakat institution or legal entity. Based on the ijtihad, Islamic Financial Institutions is obligated to pay zakat because it is a subject of law and as well as a profitable business entity.

Penulis mengambil kasus gagasan Counter Legal Draft Kompilasi Hukum Islam dan berbagai corak reaksi dan respon masyarakat sebagai contoh ruang publik yang patut diapresiasi. Sebagai kesimpulan, dapat dikatakan bahwa ketersediaan ruang publik tidak lebih dari sekadar penciptaan iklim/atmosfir yang kondusif dan kokoh untuk melanjutkan agenda pembangunan good governance yang masih belum berjalan seutuhnya.

The relationship between state executor, business actor, and people or social order that enter Good Corporate Governance and Corporate Social Responsibility on an agenda is not necessarily in an mutual acord. The paper offers three schemes in strengthening the position and relationship of the people or social order among other stakeholders. Firstly, the attitude toward neoliberalism, which is the scheme to prepare the people or the social order using future research in managing the future. Secondly, the scheme of democracy choice that has been a must in the reason economic-politic conditions. And thirdly, the attitude toward “memetic engineering,” wich is the scheme to develop populist values parallel with nation plurality that they are accepted and are not constanly put in a contradiction.

The role and function of religion recently in the government system seem to have problems because of the believers itself. The fact shows that in the government order that is led by most righteous people, the management indicates various deficiencies, such as inefficiency, authority abuse, collusion, corruption, nepotism, and society’s cooptation to support the political party of the regime. Therefore, to improve the order, it cannot be subjected to the religion believers only, without strengthening the good governance. This last statement requires knowledge, attitude, and action of the public service officials. Furthermore, this is a step of improvement of political abuse, including bad performance of bureaucracy. The article tries to highlight the significant role of religious consciousness relevant to the development of good governance. Good governance will be well -implemented, if each takes part actively, together with government, in developing community’s understanding on the importance of rational-egalitarians in the government system. It is also required a firmness of moral principles and ethic awareness of all public service officials and society to execute the good governance in the government system.

Tujuan tulisan ini adalah untuk memberikan gambaran mengenai kaitan antara nilai-nilai Islam dan elemen-elemen good governance dalam menciptakan good corporate governance maupun good government governance. Karena ada beberapa pendapat yang menyatakan bahwa kurang optimalnya implementasi good corporate governance di Indonesia sebagai akibat dari kurangnya pemahaman para pemegang kendali pemerintahan, pemilik perusahaan swasta, akademisi dan masyarakat umum terhadap pentingnya sistem ini dalam sebuah organisasi, baik organisasi pemerintah maupun nonpemerintah. Oleh karena itu, untuk memberikan pemahaman yang komprehensif kepada para praktisi dan akademisi, tulisan ini mencoba untuk memberikan pengertian mengenai anatomi corporate governance, nilai-nilai Islam dan kondisi-kondisi masyarakat Indonesia yang harus diperhatikan dalam membangun bentuk corporate governance yang cocok bagi perusahaan, institusi pemerintahan, maupun organisasi non-pemerintah di Indonesia.

Tulisan ini hendak mengkritik kondisi politik umat Islam Indonesia dewasa ini. Hal ini didasarkan pada adanya sekian banyak konsep politik dalam Islam sebagaimana juga ada dalam agama-agama besar lainnya. Dengan merujuk pada adanya keyakinan dalam agama Islam (tauhid), dimungkinkan untuk menjawab berbagai tudukan yang dialamatkan pada umat Islam dewasa ini. Pembahasan diawalli dengan membahasa konsep dictator dan kemudian diakhiri dengan konsep demokrasi. Hasilnya menunjukkan bahwa ada banyak konsep dalam Islam tentang politik kenegaraan sehingga system politik demokrasi hanyalah merupakan salah satunya saja. Dengan demikian, isu yang selama ini dibangun secara universal seperti adanya benturan peradaban sebagaimana diusung Huntington ternyata tidak terbukti, melainkan hanyalah pertarungan interen peradaban saja. Petunjuk utamanya adalah adanya system demokrasi di dalam ajaran Islam itu sendiri.

On Good Governance perspective, Indonesia has given positive contribution toward gender issues. Legally, Indonesia has fulfilled all conditions as state with good governance, but unfortunately, at the field showed that such ordinances issued were ineffective. PSI-UII’s research report has found any correlation between violence toward women and religious understanding. In the field finding will give inputs to all people who concern with the issue. Several Muslim scholars already give us some solution with interpretation toward al-Quran and Hadits, which support gender justice and equality. Government and all organization involved, have to support law and its instrument can be applied well.

This article tries to exspose that apllication of tasawuf ethics may be done to actualize Good Governance in Indonesia. The first, I give some argument why I choose tasawuf and Ghazali as a focus in this study. Tasawuf as an Islamic tradition and capacity of Ghazali are two arguments which can be used. Contextualisation of social live of Ghazali can be examined why I choose him. There are three concept from his thought about tasawuf ethic: zuhd, teleologis ethic, and ummahât al-fadhâil. These concepts can be done to practice in reforming Indonesian Good Governance.

After the destroying of World Trade Center USA on September 11 2001, America is focusing his international political policy on war on terrorism which was further followed by preemptive action and unilateralism toward countries considered a terrorist. One of them is Irak. Certainly the policy will hamper the realization of good world governance under the United Nations Program. Attacking Irak in 2003 is a real proof of the USA hegemony in the world as the Super Power, especially concerning about Saddam Husein’s process of judicature which is hold by Iraqi Special Tribunal and the Iraqi Special Tribunal is under the US intervention. Teoritically the session process of Saddam who was accused executing genocide toward Kurdi tribe should be hold by International Criminal Court (ICC) under the United Nations. It is not the competency of Iraqi Special Tribunal. The session Process of Saddam judicature is considered invalid and breaking out the principals of international law. This case will hamper the maintenance of international law supremacy. The maintenance of international law is one of the requirements of good world governance. However, the reality is showing that international politic under USA hegemony, and this will always hamper the realization of good world governance.

Umar ibn Abd al-Aziz was a great leader throughout Islamic History. He gave an outstanding role in Umayyad Dynasty. He was differ from some of his corrupted, unkind, and injustice predecessors. This Caliph which called, Umar the Second used to choose popular policy that touch the people around him. This legendary leader in Islamic History has many attractive historical evidences provoke researchers to make further studies about him. He based his policies on al-Qur’an and Sunnah. Umar II was caring and treating his people with just (justice), in another angle he also his strict forward attitude toward corrupted officials and those who violate Allah’s rules.This study reveilled variety of political decisions which was made by Umar ibn Abd al-Aziz during his leadership. Based on variety of sources, the article can find in political decisions of Umar II an example to be followed by moslem leaders nowadays and those who who are in the future as well.

REFLEKSI FILOSOFIS ATAS PENGEMBANGAN CIVIC VALUES MELALUI PEMBERDAYAAN EKONOMI MASYARAKAT BERSAMA PESANTREN

The article is the philosophical reflection on the result of the qualitative research of the two pesantren in Java, i.e., Pesantren Tarbiyatun Nasyi’in Paculgowang Jombang at East Java and Pesantren Al-Hikmah Karangmojo at Gunung Kidul Yogyakarta. The two pesantren were chosen because they have gotten the empowering training from one of the centers of Sunan Kalijaga State Islamic University. The main target of the training is to develop civic values, that is, democracy, pluralism and gender equality in pesantren and the surrounding society through the acitivities of economic empowerment of society in cooperation with pesantren. The article tries to explore and find out the results of the empowerment of the two pesantrens, and then tries to reflect them philosophically. And the main result is that the pesantrens and the surrounding peoples can accept the importance of the values of democracy, pluralism, and woman-man equality easier through the real economic activities rather than through discussion on those values in the Islamic perspective. The article can philosophically reflects that the endeavor to change the peoples’ mindset will become nothing if we do not give them the basic need for being able to survive economically. The welfare equality lead them to easily understand what the value of mutual respect making all people free.

DINAMIKA PESANTREN KONTEMPORER

This article will explain about the contemporary developments in the pesantren (Islamic boarding schools), especially its role in maintaining the tradition and stem infiltration of religious radicalism at the pesantren. The steps that can be used by pesantren is by teaching inclusive faith and the reformulation of multicultural curriculum for the students (santri). All this, with consideration for each movement by fundamentalists and extremists who cast a "jihad" to fight against those who disagree actually do not fit with the character and cultural of the pesantren. Is not the pesantren has always showed his attitude that it is always accommodating and understanding of diversity?

Towards a “Wider Mandate” of Pesantren: IN SEARH FOR A NEW NOMENCLATURE OF POLITICAL ROLE OF PESANTREN IN AN ERA OF DEMOCRACY

Makalah ini berusaha menganalisis tren kontemporer sebagian besar pesantren Indonesia dalam konteks pasca pemilihan presiden. Bahwa keberadaan pesantren tidak bisa memisahkan diri dari konfigurasi politik Indonesia. Politik dalam pesantren dapat dilihat sebagai modalitas pesantren untuk mencapai kehidupan publik lebih baik. Namun demikian, sebagian besar pesantren menyadari bahwa melibatkan diri dalam politik praktis dapat merusak citra dan kemandirian sebagai agen transformasi sosial. Oleh karena itu, pesantren perlu mempertimbangkan beberapa nomenklatur peran politik dalam rangka bertahan dalam konstelasi politik yang berubah. Untuk tantangan ini, makalah ini berpendapat bahwa pesantren perlu mendefinisikan dan memperluas mandat dewasa ini sebagai "broker politik" menjadi salah satu dari tiga nomenklatur berikut: (1) perumusan non-pemilihan politik; (2) redefinisi dari mandat ekonomi, dan (3) mengembangkan sistem teologi-politik.
