Abstract

The results of research conducted by various institutions, one of the is Political and Economic Risk Consultancy (PERC), showed that the level of corruption in Indonesia with its muslim majority, is the highestin the world. Corruption not only has hurt state finances, weaken the country’s economy and hamper national development but also has damaged the nation mentality. The Impact of this crime runs in many aspect of life, such as political aspects, law aspects, cultural aspect and educational aspect. To avoiding this crime, we need big punishment for corruption criminal. Corruption is a khiyanah crime because its character that is distorting the trust from the other (state). In Islamic criminal law, khiyanah crimes fall into the category of non-definitive crime (jarimah ghair mahdudah) which its criminal sanctions handed to the judge’s ijtihad based on the

justness and deferrent effect.
