Abstract
Study of Islamic family law in Indonesia and many Moslem countries is very interesting and urgent because Islamic family law denotes a field of Islamic law has an important position. This is because of its contribution to build society regularly and happily. Thus, many Moslem countries including Indonesia have pay attention more to Islamic law legislation as positive law for instance the Act o. 1 year 1974 regarding the marriage law, the Act No. 41 year 2004 concerning the waqf, the Act No. 7 year 1979 that has been changed by The Act No. 3 year 2006 about Religious Court. The impact of the positivization of Islamic family law is there is the certainty of Islamic law in Indonesia.
