Abstract
Kemunculan grup musik virtual atau virtual band merupakan salah satu wujud dari perkembangan teknologi dalam aspek hiburan. Virtual band merupakan suatu alternatif bagi para seniman untuk menunjukkan karya mereka tanpa perlu menampilkan wajah mereka secara langsung. Pada hakikatnya, virtual band sama seperti grup musik yang terdiri dari manusia ‘nyata’, sama-sama memiliki lagu, anggota, fans, bahkan bisa mengadakan konser. Meskipun demikian, akan muncul pertanyaan apakah karya dari virtual band juga bisa dilindungi oleh hak cipta? Kemudian bagaimana kedudukan dari virtual band dalam sudut pandang hak cipta? Apakah akan dipersamakan seperti pelaku pertunjukan? Pertanyaan ini dapat dikaji menggunakan metode yuridis normatif, dengan memanfaatkan sumber hukum primer dan sekunder, serta data yang dikumpulkan dari penelitian kepustakaan. Hak cipta juga melindungi karya dari virtual band, sepanjang ciptaan tersebut memenuhi unsur orisinalitas, kreativitas, dan fiksasi. Kedudukan hukum dapat diketahui dengan menguraikan berbagai bagian yang terdapat di dalam virtual band sehingga akan diketahui bagian dari virtual band yang termasuk ke dalam ciptaan dan siapa saja pemilik dan pemegang hak cipta. Suatu virtual band bisa saja dikategorikan sebagai pelaku pertunjukan apabila terdapat campur tangan manusia dalam hal gerakan dan suara. Pihak yang dikategorikan sebagai pelaku pertunjukan adalah manusia dan bukan karakter yang menjadi wajah dari virtual band tersebut.
