Abstract
This study highlighted the issue of arrangement for mandatory BPJS (Indonesian national health insurance) membership from the perspective of competition law. The research method used in this study was the normative juridical method, and the statute approach was employed. The results of the study indicated that the establishment of BPJS was mandated by the Law on National Social Security System (UU SJSN) and Law on National Health Insurance (UU BPJS); therefore, BPJS arrangement for mandatory membership is a permissible form of monopoly. The government monopoly through BPJS in administering health insurance is an obligation, instead, because the contribution of social security is in fact the same as taxes.

Penelitian ini mengangkat permasalahan mengenai pengaturan kepesertaan wajib BPJS dalam perspektif hukum persaingan usaha. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normati. Pendekatan yang dipergunakan dalam penelitian adalah pendekatan perundang-undangan (statute approach). Hasil penelitian menunjukkan bahwa pembentukan BPJS merupakan amanat UU SJSN dan UU BPJS, sehingga pengaturan BPJS mengenai kepesertaan wajib BPJS merupakan bentuk monopoli yang diperbolehkan. Monopoli pemerintah lewat BPJS dalam penyelenggaraan jaminan kesehatan justru bentuk keharusan karena kontribusi jaminan sosial sesungguhnya sama dengan pajak.
